What is the E-3 Visa?
The E-3 visa is a non-immigrant visa specifically for Australian nationals who wish to work in the United States in specialty occupations. It's a fantastic opportunity for skilled professionals to contribute their expertise to the U.S. workforce. Like the H1B visa, the E-3 visa requires a job offer from a U.S. employer in a qualifying specialty occupation. However, unlike the H1B, there's no lottery system for the E-3 visa, making the process potentially smoother and more predictable.
Key Advantages of the E-3 Visa
No Lottery
Unlike the H1B visa, the E-3 visa does not have an annual cap or lottery system. This provides greater certainty and predictability in the application process.
Renewable
The E-3 visa is initially granted for two years and can be renewed indefinitely, allowing for long-term employment in the U.S.
Spouse and Children
Your spouse and unmarried children under 21 can accompany you to the U.S. as E-3D dependents. Your spouse may also be eligible to apply for work authorization.
The E-3 Visa Process
Employer Sponsorship
The process begins with a U.S. employer offering you a job in a specialty occupation and filing a Labor Condition Application (LCA) with the Department of Labor. This certifies that the employer will pay the prevailing wage and that hiring you won't negatively impact the wages and working conditions of similarly employed U.S. workers.
Petition Filing
Once the LCA is certified, the employer files Form I-129, Petition for a Nonimmigrant Worker, with U.S. Citizenship and Immigration Services (USCIS).
Visa Application
If you are outside the U.S., you will need to apply for an E-3 visa at a U.S. consulate or embassy in Australia. This involves an interview and providing supporting documentation.
Entry into the U.S.
Once the visa is approved, you can enter the U.S. and begin working for the sponsoring employer.
